The Governor of the Central Bank of Nigeria CBN, Mr Godwin Emiefele has dragged the Independent National Electoral Commission INEC, Attorney General of the Federation AGF, and three others before a Federal High Court in Abuja seeking enforcement of his right to contest the 2023 Presidential election.
Mr Emiefele told the court that he can run for the post of the President of the Federal Republic of Nigeria without vacating his position as the CBN governor.
Chief Mike Ozekhome, lead Counsel to Mr Emiefele, stressed that the applicant is in a dilemma as to whether to run for the 2023 presidential election or not and therefore has come to court for interpretation of section 318 of the Constitution.
Chief Ozekhome, observed that Section 84 (12) of the Electoral Act as amended, 2022 does not affect him, being a public servant and not a political appointee, while arguing that the said section 84 (12) of the Electoral Act has been struck down by Justice Evelyn Anyadike of the Federal High Court Umuahia.
He, therefore, urged the court to order the maintenance of status quo ante bellum, pending the determination of the motion on notice.
In a ruling, Justice Ahmed Mohammed, held that having read the affidavit in support of the motion exparte directed the defendants to come on May 12, to show cause why the applicant's motion exparte should not be granted.
